A bill for an act
relating to education; allowing qualified individuals receiving a retirement
annuity to serve as a coach during a sports season; amending Minnesota Statutes
2010, section 122A.18, subdivision 3.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2010, section 122A.18, subdivision 3, is amended to
read:


Subd. 3.

Supervisory and coach qualifications; code of ethics.

commissioner of education must issue licenses under its jurisdiction to persons the
commissioner finds to be qualified and competent for their respective positions under the
rules it adopts. The commissioner of education may develop, by rule, a code of ethics
for supervisory personnel covering standards of professional practices, including areas of
ethical conduct and professional performance and methods of enforcement.

new text begin (b) Notwithstanding section 122A.15 or any other law to the contrary, the
commissioner may allow a person who receives a retirement annuity from a retirement
association listed in subdivision 7a, paragraph (b), clause (1), and (i) who was a qualified
teacher under section 122A.16 and coach while holding a continuing five-year teaching
license issued by the Board of Teaching, or (ii) who served successfully as a head varsity
coach or other school coach after meeting the qualifications under section 122A.33,
subdivision 1, clauses (1) to (3), to be employed by a school district as a coach during
a sports season. The annuity reduction provisions of section 354.44, subdivision 5, and
354A.31, subdivision 3, do not apply. A person serving as a coach under this paragraph is
not required to complete additional education or instruction.
