E Relating to health; requiring and providing for the licensing and + regulation
of outpatient surgical centers under hospital licensing and +regulation
provisions by the commissioner of health, defining outpatient +surgical center
and setting the annual license fee, exempting outpatient surgical +centers
licensed as part of a hospital from the separate licensing +requirement;
specifying certain standards for nursing care required for licensure;+ requiring
the commissioner to require diagnostic imaging facilities to annually+ report
utilization and the names of individuals with financial or economic +interest in
the facility to the commissioner, defining diagnostic imaging +facility and
granting the commissioner certain records inspection authority; +expanding
certain portions of the patients bill of rights to persons receiving +health
care services at outpatient surgical centers; requiring and providing+ for
health care providers to disclose financial or economic interest or +employment
or contractual arrangements limiting referral options with hospitals, outpatient
surgical centers or diagnostic imaging facilities to +patients upon referral to
the facilities and to post notice of the interests or +arrangements in facility
reception areas or waiting rooms, defining financial +interest, authorizing
commissioner license nonrenewal, suspension or revocation+ for failure to
comply; expanding certain hospital or outpatient surgical +center reporting
requirements; expanding the grounds for discipline by the +board of medical
practice relating to failure of physicians to disclose +financial interest upon
referral of patients to health care providers to +economic interest; expanding
the definition of vendor of medical care under +the medical assistance (MA)
program to ambulatory surgical center services; providing coverage under the
MinnesotaCare program limited benefit +set for freestanding ambulatory surgical
center services; appropriating money+ received by the commissioner from nonstate
sources to operate the adverse +health care events reporting system in fiscal
year 2005 to the commissioner and appropriating annual outpatient surgical
center licensing fees to +the commissioner for surgical centers regulation
purposes (ra, ja)
