E Providing for seizure and administrative forfeiture of certain firearms and
abandoned property; specifying property subject to seizure and forfeiture by
game and fish enforcement officers, requiring notice of seizure and intent to
forfeit to property owners, specifying certain notice content requirements,
authorizing appeal of seizure and administrative forfeiture to the commissioner
of natural resources, providing for disposal of forfeited property; expanding
the authority of conservation officers to issue trespass citations to persons
operating recreational motor vehicles; requiring judicial review and hearing of
forfeiture of motor vehicles for driving while under the influence of alcohol or
controlled substance (DWI) to take place at the earliest practicable date;
authorizing and providing for financial institutions with valid security
interests or leases covering forfeited vehicles to dispose of the vehicles in
lieu of agency disposal, requiring notice to the appropriate agency and agency
release of the vehicle to the financial institution; prohibiting sale of the
vehicle to a member of the household of the violator, exception; requiring
financial institution reimbursement to the agency for seizure, storage and
forfeiture costs before application of the sale proceeds to financial
institution costs or expenses or forwarding to the state treasury; exempting
off-road recreational vehicles and motorboats from certain requirements for
forfeiture of vehicles for fleeing a peace officer; requiring the commissioner
of natural resources (DNR) to review and assess gross violations of taking game
and fish resources and report on increased penalties to the legislature by a
