E Authorizing the commissioner of corrections to create a department of
corrections fugitive apprehension unit and appoint peace officers to perform the
duties necessary to make statewide arrests; limiting jurisdiction to
discretionary and statutory released violators and escapees; specifying
conditions and procedures for processing arrested persons; requiring the unit to
develop and file policies required for law enforcement agencies and to develop a
policy for contacting law enforcement agencies in cities or counties before
initiating fugitive surveillance, investigation or apprehension within the city
or county, requiring filing of the policies with the board of peace officers
standards and training (POST) by a certain date and requiring the filing of
subsequent revisions, requiring the department of corrections to train the peace
officers in policy application; requiring the commissioner to appoint a full
time peace officer as the chief law enforcement officer to be responsible for
managing the unit and to ensure the equipping of emergency vehicles used by the
unit with radios capable of receiving and transmitting on the same frequencies
used by law enforcement agencies with primary jurisdiction for response
coordination and notice purposes; requiring the fugitive apprehension unit to
comply with statutes and rules relating to the operation and management of law
enforcement agencies; including unit officers in the definition of peace officer
for training purposes (ra, ja)
