  1.3             requirements for spending to improve the capitol area 
  1.4             and construct bridges, environmental learning centers,

  1.7             subdivision 2; 15, subdivisions 2 and 4; and 23, 
  1.8             subdivision 28, as amended; and Laws 1996, chapter 
  1.9             463, sections 13, subdivision 2; and 24, subdivision 
  1.10            8; repealing Laws 1996, chapter 463, section 7, 
  1.11            subdivision 26. 
  1.12  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.13     Section 1.  Laws 1994, chapter 643, section 3, subdivision 
  1.14  2, is amended to read:  
  1.15  Subd. 2.  Restore and Renovate
  1.16  Capitol Building Exterior                             5,000,000
  1.17  To the commissioner of administration 
  1.18  to renovate and improve the capitol 
  1.19  including reroofing, repair of the roof 
  1.20  balustrade, and Quadriga restoration, 
  1.21  and for an exterior stone testing 
  1.22  program.  No more than $35,000 of this 
  1.23  appropriation is to the capitol area 
  1.24  architectural and planning board for 
  1.25  design review fees. 
  1.26     Sec. 2.  Laws 1994, chapter 643, section 15, subdivision 2, 
  1.27  is amended to read: 
  1.28  Subd. 2.  Bloomington Ferry Bridge          7,631,000 5,131,000
  1.29  This appropriation is from the state 
  1.30  transportation fund as provided in 
  1.31  Minnesota Statutes, section 174.50, to 
  1.32  match federal funds to complete 
  1.33  construction of the Bloomington ferry 
  1.34  bridge and approaches.  
  1.35  This appropriation is added to the 
  1.36  appropriation in Laws 1993, chapter 
  2.1   373, section 14, subdivision 2. 
  2.2      Sec. 3.  Laws 1994, chapter 643, section 15, subdivision 4, 
  2.3   is amended to read: 
  2.4   Subd. 4.  Local Bridge 
  2.5   Replacement and Rehabilitation            12,445,000 14,945,000
  2.6   This appropriation is from the state 
  2.7   transportation fund as provided in 
  2.8   Minnesota Statutes, section 174.50, to 
  2.9   match federal funds and to replace or 
  2.10  rehabilitate local deficient bridges. 
  2.11  Political subdivisions may use grants 
  2.12  made under this section to construct or 
  2.13  reconstruct bridges, including: 
  2.14  (1) matching federal-aid grants to 
  2.15  construct or reconstruct key bridges; 
  2.16  (2) paying the costs to abandon an 
  2.17  existing bridge that is deficient and 
  2.18  in need of replacement, but where no 
  2.19  replacement will be made; 
  2.20  (3) paying the costs to construct a 
  2.21  road or street to facilitate the 
  2.22  abandonment of an existing bridge 
  2.23  determined by the commissioner to be 
  2.24  deficient, if the commissioner 
  2.25  determines that construction of the 
  2.26  road or street is more cost-efficient 
  2.27  than the replacement of the existing 
  2.28  bridge; and 
  2.29  (4) paying the costs of preliminary 
  2.30  engineering and environmental studies 
  2.31  authorized under Minnesota Statutes, 
  2.32  section 174.50, subdivision 6a. 
  2.33     Sec. 4.  Laws 1994, chapter 643, section 23, subdivision 
  2.34  28, as amended by Laws 1995, First Special Session chapter 2, 
  2.35  article 1, section 48, is amended to read: 
  2.36  Subd. 28.  Environmental     
  2.37  Learning Centers                                     11,500,000 
  2.38  This appropriation is to the 
  2.39  commissioner of natural resources to 
  2.40  plan, design, and construct facilities 
  2.41  owned by political subdivisions at 
  2.42  residential environmental learning 
  2.43  centers as provided in this subdivision 
  2.44  and new Minnesota Statutes, section 
  2.45  84.0875. 
  2.46  The appropriations in items (a) through 
  2.47  (e) and (b) are available as follows:  
  2.48  (1) of the $7,500,000 total, $5,000,000 
  2.49  is available only when the commissioner 
  2.50  has determined that matching money in 
  2.51  the sum of $12,500,000, up to 25 
  2.52  percent of which may consist of loans, 
  2.53  has been committed by nonstate 
  2.54  sources for predesign, design, and 
  2.55  construction of the facilities named in 
  2.56  items (a) and (b), and the following 
  3.1   privately owned residential 
  3.2   environmental learning centers:  Wolf 
  3.3   Ridge Environmental Learning Center, 
  3.4   Northwoods Audubon Center, and 
  3.5   Southeastern Minnesota Forest Resource 
  3.6   Center; and (2) the remaining 
  3.7   $2,500,000 is available to the extent 
  3.8   that matching money, which may include 
  3.9   loans, in the amount of $2 $1 for each 
  3.10  $1 of state money is committed by 
  3.11  nonstate sources, as determined by the 
  3.12  commissioner, provided that money may 
  3.13  not be spent under this sentence until 
  3.14  the amount available, including 
  3.15  matching any money from nonstate 
  3.16  sources that is allocated to a facility 
  3.17  in item (a) or (b), is sufficient to 
  3.18  complete a functional improvement at 
  3.19  the facility.  Up to 25 percent of the 
  3.20  total amount of money committed by 
  3.21  nonstate sources under this subdivision 
  3.22  may consist of loans. 
  3.23  After the first $12,500,000 has been 
  3.24  committed by nonstate sources for the 
  3.25  Long Lake Conservation Center, the Deep 
  3.26  Portage Conservation Reserve, the Wolf 
  3.27  Ridge Environmental Learning Center, 
  3.28  the Northwoods Audubon Center, and the 
  3.29  Southeastern Minnesota Forest Resource 
  3.30  Center, the appropriations in items (a) 
  3.31  and (b) must be distributed and 
  3.32  administered separately for each 
  3.33  facility.  Money from nonstate sources 
  3.34  required for the balances of the 
  3.35  appropriations in items (a) and (b) 
  3.36  must be committed as required in this 
  3.37  section for each facility separately to 
  3.38  allow functional improvements, but work 
  3.39  at the facilities need not proceed 
  3.40  simultaneously.  Funds raised or 
  3.41  borrowed after January 1, 1992, and 
  3.42  spent or committed to be spent for 
  3.43  predesign, design, or construction of 
  3.44  these facilities are eligible to count 
  3.45  toward the required commitment from 
  3.46  nonstate sources, and, upon proper 
  3.47  application, nonstate money spent after 
  3.48  that date for qualified capital 
  3.49  expenditures at the Long Lake 
  3.50  Conservation Center and the Deep 
  3.51  Portage Conservation Reserve shall be 
  3.52  reimbursed by the commissioner from 
  3.53  money appropriated for these 
  3.54  facilities, to allow the nonstate money 
  3.55  to be used for qualified capital 
  3.56  expenditures at the Wolf Ridge 
  3.57  Environmental Learning Center, the 
  3.58  Northwoods Audubon Center, and the 
  3.59  Southeastern Minnesota Forest Resource 
  3.60  Center. 
  3.61  The predesign and design requirements 
  3.62  of Minnesota Statutes, section 16B.335, 
  3.63  do not apply to the specific 
  3.64  appropriations for these facilities in 
  3.65  this section.

  4.25  to assist with the completion of this 
  4.26  project provide financing for the 
  4.27  predesign, design, or construction of 
  4.28  environmental education facilities at 
  4.29  Southeastern Minnesota Forest Resource 
  4.30  Center, the right of reverter retained 
  4.31  by the state is waived in favor of the 
  4.32  lender. 
  4.33  For the purposes of this subdivision, 
  4.34  "nonstate source" means a source of 
  4.35  money other than a direct state 
  4.36  appropriation for an environmental 
  4.37  learning center.

  5.2   Appropriations in this subdivision must

  5.5      Sec. 5.  Laws 1996, chapter 463, section 13, subdivision 2, 
  5.6   is amended to read:  
  5.7   Subd. 2.  Capital Asset
  5.8   Preservation and Replacement (CAPRA)                 12,000,000
  5.9   To be spent in accordance with 
  5.10  Minnesota Statutes, section 16A.632. 
  5.11  Up to $900,000 of the money 
  5.12  appropriated in this subdivision may be 
  5.13  used as necessary to renovate the 
  5.14  Governor's Residence in St. Paul for 
  5.15  life safety, code, security, and 
  5.16  ancillary storage facility improvements.
  5.17  Up to $600,000 of the money 
  5.18  appropriated in this subdivision may be 
  5.19  used to continue the electrical utility 
  5.20  infrastructure conversion of the 
  5.21  primary feeder loop system to a primary 
  5.22  selective system by rerouting the 
  5.23  system around the capitol. 
  5.24  In accordance with Minnesota Statutes, 
  5.25  section 16B.31, subdivision 6, the 
  5.26  commissioner of administration shall 
  5.27  identify the condition and suitability 
  5.28  of all major state buildings and office 
  5.29  space and report the commissioner's 
  5.30  findings by June 30, 1997, to the 
  5.31  chairs of the senate committee on 
  5.32  finance and the house of 
  5.33  representatives committees on ways and 
  5.34  means and on capital investment.  The 
  5.35  report must identify the useful life, 
  5.36  the current condition, the estimated 
  5.37  cost of currently needed repairs, and 
  5.38  the suitability for the current state 
  5.39  purposes of all major state-owned 
  5.40  buildings and office space owned or 
  5.41  leased by the state.  The legislature 
  5.42  intends to use the report in 
  5.43  considering future appropriations to 
  5.44  the commissioner of administration and 
  5.45  to state agencies for asset 
  5.46  preservation. 
  5.47     Sec. 6.  Laws 1996, chapter 463, section 24, subdivision 8, 
  5.48  is amended to read: 
  5.49  Subd. 8.  Lyn/Lake/Jungle 
  5.50  Theatre Performing Arts Center                          335,000
  5.51  For a grant to Hennepin county to 
  5.52  design, construct, furnish, and equip 
  5.53  the Lyn/Lake/Jungle Theatre community 
  5.54  performing arts center to provide a 
  5.55  community theater and rehearsal space, 
  5.56  offices, classrooms and meeting rooms 
  5.57  for performing arts organizations, arts 
  5.58  education, and arts development and 
  5.59  outreach in a formerly tax-forfeited 
  6.1   structure in Hennepin county.  Hennepin 
  6.2   county may contract with a nonprofit 
  6.3   organization for operation of the 
  6.4   center, subject to Minnesota Statutes, 
  6.5   section 16A.695.  This appropriation is 
  6.6   not available until the commissioner 
  6.7   has determined that at least $1,630,000 
  6.8   has been committed by nonstate sources 
  6.9   to complete the Lyn/Lake/Jungle Theatre 
  6.10  main stage in a nearby building owned 
  6.11  and operated by the Jungle Theater and 
  6.12  that $100,000 has been committed by 
  6.13  nonstate sources to complete the 
  6.14  community performing arts center.  This 
  6.15  is the final state appropriation for 
  6.16  this project. 
  6.17     Sec. 7.  [APPROPRIATION.] 
  6.18     $1,035,000 is appropriated from the general fund in fiscal 
  6.19  year 1998 to the commissioner of administration to predesign, 
  6.20  design, construct, furnish, and equip the renovation of the 
  6.21  capitol cafeteria and related spaces.  The appropriation is 
  6.22  available until June 30, 1999, and is contingent upon approval 
  6.23  of the council on disability. 
  6.24     Sec. 8.  [REPEALER.] 
  6.25     Laws 1996, chapter 463, section 7, subdivision 26, is 
  6.26  repealed. 
  6.27     Sec. 9.  [EFFECTIVE DATE.] 
  6.28     This act is effective the day following final enactment.
