  1.1                          A bill for an act
  1.2             relating to peace officer training; requiring peace 
  1.3             officers to undergo training in community policing 
  1.4             techniques; proposing coding for new law in Minnesota 
  1.5             Statutes, chapter 626. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [626.8455] [TRAINING IN COMMUNITY POLICING.] 
  1.8      Subdivision 1.  [TRAINING COURSE.] The board, in 
  1.9   consultation with the Minnesota institute of community policing, 
  1.10  shall prepare a training course to instruct peace officers in 
  1.11  the techniques of community policing.  The course must include 
  1.12  instruction on at least the following matters: 
  1.13     (1) techniques for expanding the training of peace officers 
  1.14  to include problem-solving; 
  1.15     (2) techniques for organizing community members so that 
  1.16  they are involved and trained in community policing activities; 
  1.17     (3) techniques for relating to diverse communities; and 
  1.18     (4) techniques for relating to physically or mentally 
  1.19  impaired individuals. 
  1.20     The course also must include training on child development 
  1.21  issues to enable officers to respond appropriately to perceived 
  1.22  child protection situations.  The board shall update the 
  1.23  training course periodically as it deems appropriate. 
  1.24     Subd. 2.  [PRESERVICE TRAINING REQUIREMENT.] An individual 
  1.25  is not eligible to take the peace officer licensing examination 
  2.1   after August 1, 1997, unless the individual has received the 
  2.2   training described in subdivision 1. 
  2.3      Subd. 3.  [INSTRUCTIONAL MATERIALS.] The board shall 
  2.4   provide to chief law enforcement officers instructional 
  2.5   materials patterned after the materials developed by the board 
  2.6   under subdivision 1.  These materials must meet board 
  2.7   requirements for continuing education credit. 
  2.8      Sec. 2.  [IN-SERVICE TRAINING PLAN.] 
  2.9      The board shall develop a plan for providing the training 
  2.10  described in section 1, subdivision 1.  The board shall develop 
  2.11  this plan in conjunction with the Minnesota institute of 
  2.12  community policing, the Minnesota chiefs of police association, 
  2.13  the Minnesota sheriffs association, and the Minnesota police and 
  2.14  peace officers association.  The plan must recommend a schedule 
  2.15  for implementing the training which takes into account the size 
  2.16  and resources of the employing law enforcement agencies, an 
  2.17  estimate of the costs associated with the training, and 
  2.18  recommendations for funding the training.  An individual who is 
  2.19  licensed before August 1, 1997, shall receive training in 
  2.20  accordance with the plan beginning January 1, 1998.  The board 
  2.21  shall report its plan to the house and senate committees with 
  2.22  jurisdiction over criminal justice matters. 
  2.23     Sec. 3.  [EFFECTIVE DATE.] 
  2.24     Sections 1 and 2 are effective the day following final 
  2.25  enactment.  Section 1, subdivision 2, applies to peace officer 
  2.26  licensing examinations administered after July 31, 1997.
