A bill for an act
relating to manufactured homes; requiring relocation compensation for displaced
residents; amending Minnesota Statutes 2006, section 327C.095, subdivision 4.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 327C.095, subdivision 4, is amended to
read:


Subd. 4.

Public hearing; relocation deleted text begin costsdeleted text end new text begin compensationnew text end .

new text begin (a) new text end The governing body
of the new text begin affected new text end municipality shall hold a public hearing tonew text begin :new text end

new text begin (1) new text end review the closure statement and any impact that the park closing may have on
the displaced residents and the park ownernew text begin ; and
new text end

new text begin (2) determine relocation compensationnew text end .

Before any change in use or cessation of operation and as a condition of the change,
the governing body deleted text begin maydeleted text end new text begin mustnew text end require a payment by the park owner to be made to the
displaced resident for the reasonable relocation costs.new text begin Reasonable relocation costs include,
but are not limited to, at least the sum of the following:
new text end

new text begin (1) actual expenses incurred in moving the displaced resident's manufactured home
and personal property, including the reasonable costs of disassembling, moving, and
reassembling any attached appurtenances, such as porches, decks, skirting, and awnings,
which were not acquired after notice of closure or conversion of the park, and utility
hookup charges;
new text end

new text begin (2) the cost of insurance for the replacement value of the property being moved;
new text end

new text begin (3) the cost of repairs or modifications that are required in order to take down,
move, and set up the manufactured home;
new text end

new text begin (4) the cost of installation of anchoring, foundation, and support systems as
recommended by the manufacturer, required by manufacturer warranties or required
by state law or administrative codes; and
new text end

new text begin (5) other costs or expenses the municipality deems appropriate.

new text begin (b) new text end If a resident cannot new text begin or chooses not to new text end relocate the home to another manufactured
home park within a 25 mile radius of the park that is being closed, new text begin or to some other agreed
upon location or distance,
new text end the resident is entitled to deleted text begin relocation costs based upon an average
of relocation costs awarded to other residents
deleted text end new text begin compensation to be paid by the park owner
in an amount equal to the estimated market value of the manufactured home, provided the
resident tenders title to the manufactured home

new text begin (c) new text end The governing body of the municipality may also require that other parties,
including the municipality, involved in the park closing provide additional compensation
to residents to mitigate the adverse financial impact of the park closing upon the residents.
