A bill for an act
relating to health; requiring the commissioner of health to develop health risk
limits for certain perfluorochemicals; requiring a report on the health effects and
health risk limits for perfluorochemicals.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

new text begin By August 1, 2007, the commissioner of health shall develop and adopt by rule,
pursuant to Minnesota Statutes, section 14.388, subdivision 1, clause (1), health risk limits,
as defined in Minnesota Statutes, section 103H.005, subdivision 3, for perfluorooctanoic
acid, and perfluorooctane sulfonate. The commissioner shall develop and adopt the health
risk limits according to Minnesota Statutes, section 144.0751, and ensure that the health
risk limits are based on currently available toxicity and exposure data.

Sec. 2. new text begin HEALTH RISK LIMITS FOR PERFLUOROCHEMICALS; REPORT.

new text begin By January 15, 2008, the commissioner of health shall provide a report to the house
of representatives and senate committees with jurisdiction over health and environmental
policy on the commissioner's progress in determining the health effects and the
development of the health risk limits, as defined in Minnesota Statutes, section 103H.005,
subdivision 3, for perfluorochemicals. By September 30, 2007, the commissioner shall
provide an interim status report to the committees. The report shall include, but is not
limited to:

new text begin (1) the health effects and health risk limits adopted for perfluorooctanoic acid and
perfluorooctane sulfonate;

new text begin (2) the health effects and the need to develop health risk limits for perfluorobutanoic
acid and other perfluorochemicals;

new text begin (3) the health effects and the need to develop health risk limits for combinations of
perfluorochemicals; and
new text end

new text begin (4) a comparison of health-based values for perfluorochemicals established in
Minnesota and the values established for those chemicals in other states including the
state of New Jersey.
