FIRST ENGROSSMENT
Freedom to Breathe Act of 2005 established requiring
persons to refrain from smoking in certain areas including places of employment,
public transportation, bars, and restaurants.
Section 1: "Public Place"
definition modified.
Sec. 2: "Smoking" definition clarified.
Sec. 3:
Responsibilities of proprietors of public places clarified and modified
pertaining to prevention of public smoking.
Sec. 4: Permitted public smoking
specified.
Subdivision 1: Certain scientific study participants permitted to
smoke.
Sub. 2: Traditional Native American ceremony participants permitted to
smoke.
Sub. 3: Bars with intoxicating liquor licenses of specified types
permitted to allow smoking.
Sub. 4: Private clubs permitted to allow
smoking.
Sub. 5: Restaurants closed to the public while being used for private
functions permitted to allow smoking.
Sub. 6: This act does not pertain to
smoking in private homes, residences, automobiles, hotel & motel rooms.
Sec. 5:
Technical statutory reference modified.
Sec. 6: Local government ordinances
clarified.
Sec. 7: Act named as the "Freedom to Breathe Act of 2005:"
