4E Providing for the collection and recycling or reuse of video display devices;
providing for commissioner of revenue data collected under the video display
device recycling program and registration fees, authorizing certain disclosures;
defining certain terms; establishing a registration program under the pollution
control agency (PCA) and specifying certain manufacturer labeling and
registration requirements for the sale of new household video display devices,
specifying collector and recycler registration requirements, requiring PCA web
site information maintenance; establishing the electronic waste account in the
environmental fund, requiring annual manufacturer registration fee payment to
the department of revenue, appropriating money annually until a certain date
from the account to the PCA for administration purposes and for distribution of
competitive grants to counties and private entities outside the metropolitan
area with preference given to helping manufacturers reach their recycling
obligations; specifying manufacturer, recycler and collector annual reporting
requirements and manufacturer, recycler and retailer responsibilities;
specifying PCA and department of revenue duties and state agencies purchasing
requirements and specifying certain responsibilities of the department of
administration, imposing civil penalties for violations; requiring the PCA
retail form development and website manufacturer contact information
publication; prohibiting local government units and public agencies from
requiring household to use public facilities to the exclusion of other lawful
available programs to recycle electronic devices; providing for supersession of
federal regulation and limitations upon federal law enactment; authorizing the
PCA and department to help establish and implement a regional multistate
organization or compact to assist in recycling video display devices; requiring
the PCA to report on revenues received and expenditures made in 2008-2009 and to
request the governor to recommend a direct appropriation to fund the
program
