7045.0540 AIR EMISSION STANDARDS FOR TANKS, SURFACE IMPOUNDMENTS, AND CONTAINERS.

Subpart 1.

Incorporation of federal regulations.

The owners and operators of facilities that treat, store, or dispose of hazardous waste in tanks, surface impoundments, or containers must comply with Code of Federal Regulations, title 40, part 264, subpart CC, air emission standards for tanks, surface impoundments, and containers, sections 264.1080 to 264.1090, as amended, which are incorporated by reference subject to the exceptions in subpart 2.

Subp. 2.

Additions, modifications, or exceptions to incorporated regulations.

A.

The agency does not incorporate the following Code of Federal Regulations, title 40, part 264, subpart CC provisions, as amended:

(1)

Code of Federal Regulations, title 40, section 264.1080(d) to (g), governing specific exclusions; and

(2)

Code of Federal Regulations, title 40, section 264.1082(c)(4)(ii), governing authority that EPA cannot delegate to states.

Part 7045.0090, adoption and incorporation by reference, also applies.
